If your patent case moves to a federal circuit court, it's typically for appeals. Rich Beem worked in these courts for a few years and knows what works and what doesn't with appeals. Now, if you won the patent case in the lower courts your brief will be in a red folder. This is a definite advantage for you. The appeals court is a court of errors -- which means unless there is an error in the case -- your win will uphold in the appeals stage. Those that lost in the lower courts will be in a blue folder. If your case does go to appeals, there will be issues you will need to prove or resolve to win. The fewer issues you have the better. Someone with 10 issues to win on appeal has a far greater chance to lose than say someone with an issue or two. As we stated earlier, telling a story in court is very important. A brief usually wins the case and needs to have pertinent information but not read like a technical manual. The court wants to see the facts of the case, so it's important to cite those records. You need to prove your case, and shown that you've proven -- you cannot expect the judges to go prove it for you. Lastly, in the federal court, your case has 15 minutes in a typical case. That's a small amount of time to prove you deserve to win, so having someone who understands the things that need to be done -- and do them correctly -- is extremely important. Lining up your facts in a certain order to tell a story is classic Lincoln, and helps the people you're trying to convince understand your matter. Secondly, giving simple exhibits is best. When showing a pen to a jury is much more simple and effective than showing the machine that makes a pen and explaining it -- do so. Showing an actual product helps people understand and connect your points with the product. Lastly, Rich Beem suggests a sense of humor. We do this by bringing witnesses and evidence into the trial that proves our case. Whether it is expert witnesses like engineers, inventors, or managers of a company. Or it could through exhibits such as documents, physical exhibits, and electronic exhibits, chemical compositions of the product or even the actual products. We also have to prove invalidity on the part of the other party - which means we have to prove why we're right and their product or patent is invalid.
