Garner ISBN: 978 0 19 538420 8 Oxford University Press www.oup.com A PARADIGM FOR GUIDANCE ON LEGAL WRITING An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers It is ironic, is it not, that 'legal language' quite often seems opaque and all too often is so; unfortunate too, as the law is based on words, forms of words, meanings of words and their interpretation, connotation and usage. One wonders how often cases have been initiated, then won or lost because someone or other has misconstrued or misinterpreted some word or other -- or some phrase or other. If you're a lawyer, legal scholar, student, or generally someone who is fascinated by the power of language and who seeks to speak and write with clarity, precision and force, Garner's Dictionary of Legal Usage is the resource for you. Here it is from the Oxford University Press in a new enlarged and updated third edition and a remarkable work of lexicography it is. But it's not just a dictionary. It also functions as an authoritative guide to style, grammar and usage. As you look up each word, you are offered not just a definition, but a discussion of its significance, its origins, indeed all its aspects pertaining to law, complete with meticulously cited sources. Prolifically and painstakingly (and often entertainingly) the learned editor, Bryan A Garner, internationally acknowledged as a top authority on legal usage, seeks to blow away the cobwebs of complexity and confusion which may surround any number of terms. 'Testatorial, testorial, testatory' is an example. What's the difference? What is the most common form? Is there a reference to the OED? Look these up if you wish to know. You'll find them just before the word 'testatrix', which the editor quite rightly has a down on. 'This word is useless,' he growls. 'testator quite properly referring to men and women alike. See SEXISM.' Well -- you've been told, haven't you? And you have been referred onward toward further research as well. It's a comprehensive, erudite and easy to use resource which lawyers and laymen alike will find invaluable. Synonyms, for example, are precisely differentiated and defined and such areas of law as immigration, intellectual property are discussed in the clear light of day. Ooops... we shouldn't have said that! Garner and his team have provided a pungent entry on the matter of clichés and overused words which ideally we must avoid, although some of our pet hates have been left out like 'iconic' and 'going forward.' These will no doubt surface in the next edition! Usefully, the orientation of this dictionary (of almost 1,000 pages) is transatlantic. So whether your practice is in the UK or North America, this is certainly an indispensable guide to writing or editing legal documents, books or articles with enhanced clarity, accuracy and style. To today’s viewer, the short film made in 1973 for an American Heritage Dictionary marketing campaign looks silly and dated (typewriters? secretaries?). But that’s what makes it so much fun to watch. A takeoff on popular TV shows and movies, it was produced by Bill Miller Film and features dictionary staff and other Houghton Mifflin employees performing skits about pronunciation, usage, and meaning. Watch a well-dressed, middle-aged woman get doused with water (“I said vichyssoise, not Vichy water! Ho ho!! All the way down!”). Watch a person in a bear suit run around a secretary’s desk hoisting a chair (“Take a seat, Mr. Bear”). Watch a man on the street being asked what he thinks about the sentence “The boy was bit by the dog” (“That’s too bad!!”). Watch--well, just watch the whole thing. It’s good for a few laughs and as a reminder of the excitement surrounding the publication of a fledgling American dictionary (first published in 1969). The folks at Merriam-Webster Dictionary were among the millions who tuned in last night to watch the first 2016 presidential debate between Donald Trump and Hillary Clinton. The dictionary schooled the GOP nominee for his use of the word "braggadocious," a word which he's used in debates before. It is essential to remember the new word learnt so here are some tips that will help you to do so. 1) Use the new word in a sentence: After you have read the word and understood its meaning, use the new word in your own sentence. Try to create sentences in context with your daily life. 2) Look for grammatical Variations: Look for various grammatical forms of the new word that u learns. For example the word entice is a verb where as the adjective form is enticing and the adverb is enticingly. Enticed would be the past and past participle of the word entice. Once you have the different grammatical forms you would end up learning many words just with one word. 3) Learn Associations and Connections: Try to associate and connect the word more with the help of the search engines like Google. Look for its synonyms and antonyms. Again this will help you to learn more words connected to the original word you have learnt. 4) Always carry a notepad with you: Write the word, its meaning and a sentence in a small notepad or your smart phone that you can carry it around. Go though these words in your spare time. This will help you to remember it well. 5) Make Flash Cards: Make little flash cards with each new word on one side and the meaning on the other. Put them on the ground and if the meaning is face up try to think of the word or vice versa. 6) Learn the word again before you forget: Don't just learn or practice a word a day and then forget about it. So you’ve probably been told never to begin a sentence with “coordinators” like “and,” “so” or “but.” But this is not just dead wrong; it’s un-dead wrong. Linguist Arnold Zwicky calls “No Initial Coordinators” a “zombie rule”; no matter how many times you shoot this ghoul down, it keeps coming back. Zwicky speculates that the fake rule comes from elementary school teachers fighting against children’s tendency to overuse conjunctions: “And I went to lunch. And I ate tater tots. And then, and then, and then…” Passive voice. OK, we can all agree that using the passive voice too often is really annoying. “The trout was caught by Alice.” “The gallon of ice cream was eaten by Jeffrey.” Passive voice makes sentences sound like they come from a police blotter, but there’s nothing technically wrong with it. Some writers use passive voice in moderation for effect or to vary sentence structure. It’s not wrong. But yes, it should be used frugally. Less is fewer. In 1770, the Merriam-Webster Dictionary of English Usage laid down the law: The word “less” is used to describe an uncountable collection: “less water,” “less respect.” “Fewer” is for countable objects: “fewer blueberries,” “fewer rubber gloves.” But this doesn’t always work. I mean, is it really better to say “The party is fewer than 5 miles away,” or “The plumber says it will take fewer than 2 hours?” If “fewer” makes the sentence clang, don’t feel pressure to use it. Never end a sentence with a preposition. Some languages actually do ban the terminal preposition, like Classical Latin. And the Anglican bishop Robert Lowth continued this convention in an English grammar guide he published in 1762. But English isn’t Latin, and other linguists have pointed out that it’s perfectly natural to end an English sentence with a preposition. This is one wrong grammar rule up with which I will not put. Never split an infinitive. Infinitives: The pure, un-conjugated form of a verb. In English, they come pre-packaged with the word “to.” So: “To dig,” “to sneeze,” “to saw”. Splitting is when you stick an adverb in there: “to gleefully saw.” Though high school teachers love to get the red pen out for this one, modern style guides are almost unanimous in saying you should feel free to proudly split infinitives when the sentence calls for it.
