Garner ISBN: 978 0 19 538420 8 Oxford University Press www.oup.com A PARADIGM FOR GUIDANCE ON LEGAL WRITING An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers It is ironic, is it not, that 'legal language' quite often seems opaque and all too often is so; unfortunate too, as the law is based on words, forms of words, meanings of words and their interpretation, connotation and usage. One wonders how often cases have been initiated, then won or lost because someone or other has misconstrued or misinterpreted some word or other -- or some phrase or other. If you're a lawyer, legal scholar, student, or generally someone who is fascinated by the power of language and who seeks to speak and write with clarity, precision and force, Garner's Dictionary of Legal Usage is the resource for you. Here it is from the Oxford University Press in a new enlarged and updated third edition and a remarkable work of lexicography it is. But it's not just a dictionary. It also functions as an authoritative guide to style, grammar and usage. As you look up each word, you are offered not just a definition, but a discussion of its significance, its origins, indeed all its aspects pertaining to law, complete with meticulously cited sources. Prolifically and painstakingly (and often entertainingly) the learned editor, Bryan A Garner, internationally acknowledged as a top authority on legal usage, seeks to blow away the cobwebs of complexity and confusion which may surround any number of terms. 'Testatorial, testorial, testatory' is an example. What's the difference? What is the most common form? Is there a reference to the OED? Look these up if you wish to know. You'll find them just before the word 'testatrix', which the editor quite rightly has a down on. 'This word is useless,' he growls. 'testator quite properly referring to men and women alike. See SEXISM.' Well -- you've been told, haven't you? And you have been referred onward toward further research as well. It's a comprehensive, erudite and easy to use resource which lawyers and laymen alike will find invaluable. Synonyms, for example, are precisely differentiated and defined and such areas of law as immigration, intellectual property are discussed in the clear light of day. Ooops... we shouldn't have said that! Garner and his team have provided a pungent entry on the matter of clichés and overused words which ideally we must avoid, although some of our pet hates have been left out like 'iconic' and 'going forward.' These will no doubt surface in the next edition! Usefully, the orientation of this dictionary (of almost 1,000 pages) is transatlantic. So whether your practice is in the UK or North America, this is certainly an indispensable guide to writing or editing legal documents, books or articles with enhanced clarity, accuracy and style. The dictionary schooled the GOP nominee for his use of the word "braggadocious," a word which he's used in debates before. During the debate Trump said, “I have tremendous income, and the reason I say it is not in a braggadocious way.” Merriam-Webster quickly tweeted, "He was trying for braggadocio." Writing is notoriously hard, even for the best writers, and it's not for lack of good advice — a tremendous amount of knowledge is strewn across usage guides, dictionaries, technical manuals, essays, pamphlets, websites, and the hearts and minds of great authors and editors. But this knowledge is trapped, waiting to be extracted and transformed. We built Proselint, a Python-based linter for prose. Proselint identifies violations of expert style and usage guidelines. Proselint is open-source software released under the BSD license and works with Python 2 and 3. It runs as a command-line utility or editor plugin (e.g., Sublime Text, Atom, Vim, Emacs) and outputs advice in standard formats (e.g., JSON). Though in its infancy – perhaps 2% of what it could be – Proselint already includes modules addressing: redundancy, jargon, illogic, clichés, sexism, misspelling, inconsistency, misuse of symbols, malapropisms, oxymorons, security gaffes, hedging, apologizing, pretension. Proselint can be seen as both a language tool for scientists and a tool for language science. On the one hand, it includes modules that promote clear and consistent prose in science writing. On the other, it measures language usage and explores the factors relevant to creating a useful linter.

My name is Emma, and in today's video, I will teach you a trick on how to remember vocabulary. So English has the largest vocabulary out of any language. I think it's close to 600,000 words in English. So how are you going to remember so much vocabulary? Well, when I was in China, I created a little trick -- and other people use this trick, too -- that really helped me to remember all the new words I was learning. So in this video, I will teach you this trick. So what you do -- I have a bunch of interesting pictures on the board -- is any time you come up across a new word and you're learning a new word, you need to make a picture in your head of this word. A good idea is to try to think of other words that sound like this word and imagine funny situations in your mind. So what do I mean by that? Well, let me show you. The first word I'm going to teach you today is "bald", "bald", b-a-l-d. What does it mean to be "bald"? It means to have no hair, okay? So if you have no hair, you are "bald". How do you remember this word? Well, if you use my trick, you can imagine a word that sounds like "bald" -- maybe "ball", basketball, soccer ball. So in your mind, I want you to imagine a ball. It can be a basketball, a soccer ball -- any type of ball. Now, imagine the ball with a face. Imagine the ball with no hair on top, maybe a little hair on the side, a little hair here, but no hair on the top. Because "ball" and "bald" sound alike, if you imagine this picture for maybe ten seconds, it will help you to remember it in the future, okay? Think "ball with no hair". Okay. Let's try our second word: "beard". What's a beard? It's the hair that comes off a man's chin -- usually, women don't have beards. So it's the hair that comes down like this. How are we going to remember this word? Well, imagine a man with a beard, and inside the beard is a bird, a little bird, tweet tweet! And what's it doing in the beard? Why, it's drinking beer. Okay? So this little picture is -- don't know if you can see that, but that is beer. So imagine a bird drinking beer. Those two words together -- beer. This isn't beer; this one is. Imagine "bird" and "beer". Together, if you put the words together, they make "beard". A bird drinking beer in a beard. Can you say that fast? "Bird drinking beer in a beard." So maybe, if you picture this for ten seconds, you will remember this word. Okay. Next word I want to teach you today: "creamed". So what does it mean to be "creamed"? "We creamed you guys." "You guys got creamed." It means someone lost a game very badly. If our team creamed your basketball team, your basketball team lost; our team won. So you don't want to be "creamed". If you get "creamed", it's bad. It means you lost, you lose. So how can you remember this? Well, imagine someone -- maybe somebody you don't like, somebody you play basketball against or some sport. Imagine throwing a bunch of ice cream and it hits their face -- because the keyword "cream", "ice cream". So if you can imagine ice cream on someone's face, it will help you to remember the word "creamed". So imagine that for ten seconds. So think "ice cream on face", "creamed".
