by Andrew Chen, Andreessen Horowitz If you look at consumer adoption curves of major new technologies in the U.S. over the past 100 years, you'll see interesting patterns in both growth and behavior change. Some took longer, some came faster (especially lately, as we reach new heights of software eating the world) -- but one thing is for sure: Technology changes, but people stay the same. Even if in some cases new technology requires people to learn new behaviors, the underlying motivations behind those behaviors are the same... not just across people and places, but across history and time. So what does this mean for the next wave of consumer startups? As new tech platforms -- such as video, mapping APIs, mobile AR, and more -- hit scale, a the next big wave of consumer products and startups are coming into the ecosystem. But finding and nurturing these startups requires a special combination of understanding the fundamental platform shift; underlying consumer motivations/needs; and key growth insights that enable them to breakout from the fray. The Touch And Feel Of Consumer Products
(Inside Science) -- I love learning about a new field of science. It’s like finding a new book by a great author or discovering that your favorite restaurant has a special tasting room upstairs -- like it’s been there all the time but you never looked up. The field of psychorheology is like that for me. Most of my life, I had never heard of it. But I’ve come to discover I reap its benefits in many everyday consumer products -- everything from hot cocoa to sunscreen. Psychorheology touches upon how products feel – or more specifically, how we feel when we touch products. That makeup, that hand lotion -- is it oily, dry, smooth, stiff, rough, thick, light or foamy? Companies care about these things because consumers care. We demand a certain flavor, a certain color, a certain scent. And likewise, we seek a certain texture. How does it feel? That’s exactly what psychorheology seeks to achieve. Matjaz Jogan, at Johnson & Johnson said, “This work is about human perception. The question is how to do our consumers perceive a product in terms of how thick they are.” Jeffrey Martin, at Johnson & Johnson said, “Our projects started when I would get many scientists who were making formulations and they would come to me and say, ‘I’m trying to match the aesthetics of a product that is on the market right now. I have a few different prototypes and I would run many different measurements.’ Of course, it’s never going to match exactly, so I would have to go back to them and say, well here’s a prototype that matches very close. And then I would always get that question, is the difference noticeable by the consumer? And I would always have to answer, I don’t know.” “We want the consumer to be happy with the product. So, the consumer experience is very important. We can evaluate this experience by basically measuring it by questionnaires or also by measuring their preferences. For measuring their preferences, we can use different tools like eye tracking, measuring their pupil sizes on emotional reactions,” said Jogan. “All of the different sensory cues for a certain prototype are very important. You can have a lotion that we can show really through data, and you can show a really good benefit and it can have very good aesthetics, but if it doesn’t have a good fragrance it’s not going to get used,” said Martin. “Like having more and more data and more merchant models, we should get closer to what the consumer in the end really wants. Especially now that consumer preferences are changing at a very fast pace,” concluded Jogan. The emergence of smart technology brings many opportunities for consumers; access to new services, more responsive products, greater convenience and choice. Here in Jamaica we are upgrading, adapting and streamlining technologies that influence our way of doing business with the people. From the government to the private sector. It was not long ago we passed the Jamaica Credit Reporting Act (2010), to facilitate greater access to financial services and products. Also on the horizon, NIDS, a National Identification System and the Data Protection Act. The digitization of pension benefits is now a reality. There are, however, some significant causes for concern: lack of security, privacy and meaningful choice over how we use them, as well as a lack of clarity about who is responsible when things go wrong. For example, getting a bad credit rating due to identity theft. There are also issues around lack of access, with millions of people globally locked out of this new technology by overly high data charges. There are still ways to go and we shall be with you every step of the way. Strong and consistent advocacy will be in greater demand, especially when things are not working in the consumer's interest.

Above all, the really great news is that both of our two strategic growth categories outperformed the market: make-up grew double digit, thanks to our one-of-a-kind brand portfolio. And Haircare is performing very well, with the success of Ultra Doux. The second highlight is that we have now four major global brands - with L’Oréal Paris, Garnier, Maybelline, and NYX Professional Makeup - and all four of them are growing. What’s exciting there is that NYX Professional Makeup is the first significant extension to our line-up since we acquired Maybelline 20 years ago, and it is already proving incredibly successful in 40 countries. What’s equally exciting is that we are deploying these brands across a worldwide multichannel environment, with e-commerce growing at more than 30%, but also branded retail, thanks to the successful opening of almost a 100 NYX Professional Makeup stores. Last but not least, all the Regions are performing well. In North America, we had an outstanding sales performance: we grew much faster than the market, reaching our highest market share ever - and that in spite of being already a leader there. In Western Europe, after a flat year in 2015, we are back to growth reinforcing our leadership. And in the New Markets, the Division grew and gained market share. - What are tomorrow’s major prospects? I’d say we have four strategic levers to ensure sustainable growth going forward. Firstly, we are accelerating the deployment of game-changing innovations. There are a number of elements that give us a clear competitive advantage compared to local brands and major players. In particular, we have: • a global and multichannel footprint, • unique research and innovation capabilities, • and a century-long background in beauty culture and expertise. These assets have helped us launch some major innovations last year, including Magic Retouch by L’Oréal Paris, and Micellar Water by Garnier, to name just two. And we will accelerate in 2017 starting with Colorista by L’Oreal Paris, a true haircolour revolution for Millennials: this is the NYX Professional Makeup of haircolour. Secondly, we are strengthening our make-up power house: the category is booming everywhere in the world. We have a portfolio of 4 global brands, each of them with a very clear brand equity, and a very strong innovation programme. Our third lever is our ability to develop core major ascending beauty trends. These are natural haircare, with Ultra Doux, the New Fructis by Garnier, Phytoclear and Botanicals, our new L’Oréal Paris brands. And the second ascending trend is natural skincare, that we will develop with Garnier. Our fourth strategic lever is to maximize our digital clout: digital is a source of inspiration for innovation, mainly through social listening as we have done for Colorista. But also digital allows us to master programmatic advertising. The law of contract will also provide relief to the consumer in relation to defective products; legislation such as Liability for Defective Products act 1991, the Civil Liability Act of 1961 and other more modern European legislation including directives and regulations. Liability For Defective Products Act 1991 Under this act the consumer does not need to prove negligence on behalf of the supplier or retailer; he/she merely needs to show that the product caused the consumer damage because of a defect in the product. Liability For Defective Products Act, 1991 2.—(1) The producer shall be liable in damages in tort for damage caused wholly or partly by a defect in his product. (Section 2 Liability for Defective Products Act 1991). It is a strict liability therefore the consumer does not need to show any negligence on the part of the manufacturer. So you just need to show a link between the product and the damage suffered. The Statute of Limitations, that is the time within which an action must be brought, is three years. There is also a long stop cut off point of 10 years, that is a claim may not be brought after 10 years from the introduction of the product into circulation.
