these videos are not for entertainment, they are clearly "fair dealing" under UK copyright law and are exempt as they are reporting current affairs, as I am sure you are aware UK courts "bear in mind that considerations of public interest are paramount". UK courts see the fair dealing defence usually only applies when part of a work has been taken such as small clips as per my youtube videos. Reporting of current events Under Section 30(2), fair dealing using any work for the purpose of reporting current events, with sufficient acknowledgement, is a valid exception to copyright. Photographs are excluded, however; Cornish, Llewelyn and Aplin write that this is "in order to preserve the full value of holding a unique visual record of some person or event" The BBC cant help themselves.

But you have to accept that there will be people who don’t like it. And they are completely within their rights just as you are completely within your rights to say whatever you want to say. They’re within their rights to react how they’re going to react. So you can’t be surprised or insulted if someone doesn’t like a thing you said that is a, you know, you’re making jokes on a controversial topic. I think there’s a lot of people who court that and they want that because it’s attention – it gets more eyeballs on them and what they’re doing. But there’s some people who do feign outrage at this or they’re genuinely feeling like how dare you tell me what I can and cannot joke about. But I would say in most cases audiences are not telling them you can’t joke about this. What they’re saying is that wasn’t funny. And that’s a different thing. I think you can talk about any topic and I think you can make any topic funny. It depends on what your point is and where you’re coming from. Audiences always know. They always know. And if you have a sound point that you’re making and it’s well thought out and it’s well-crafted you can make me laugh at a thing that I think is tragic. You can make me laugh at a thing that I think is horrific. You can make me laugh at a thing that affects me personally. But if you’ve done your homework and you’ve gone about it the right way it will still be funny. But it’s when people do I think a lazy job at something. They’re not trying as hard as they could. Or they really are just courting outrage. That’s when audiences say that wasn’t funny. But I think it’s so rare, it’s so rare that anyone says you’re not allowed to joke about that. Tastes change over the years and so topics that were routinely joked about years ago that might affect certain people, maybe it’s something that happened to someone and we throw a word around because it’s a shocking punchline and it’s good for a laugh. But is it worth it? And over time people who are tired of being ashamed because a thing happened to them they vote with their silence or they say that’s not funny. And I think that comedians have to recognize that humor evolves and times change and you can’t stay stuck in the same place for too long because then you’re irrelevant. And so it’s very easy to say oh people are too uptight now. They’re too uptight. But the fact of the matter is these people are the people of today and you might be a person of yesterday if you can’t adjust and you can’t be in tune with what people think is funny anymore. I don’t think I’ve ever said anything where an audience turned on me in that way. I’ve said things that now I wish I hadn’t said because times have changed and like the me of 15-20 years ago made a joke that I wouldn’t make today because I – just because I look at the world differently now, you know. And because the world is different now. And, you know, it’s all part of a maturation process I think for everybody. And I’m of the school that says adapt or die, you know. And so if this is not a thing that we joke about anymore I’m going to find something else to joke about. Or I’m going to be better at handling these subjects so that people know what my intent is. My intent is not to mock the victim here. It’s not to mock the little person. I’m ridiculing something that is worthy of ridicule and that every word out of my mouth is worth the same. And just not to be cheap I think is a tiny thing but it’s kind of important.

There’s a real competition going on. And it’s sweeping the nation: progressive vs. progressive competing to see who can most flamboyantly claim to be offended; to proclaim that their feelings have been hurt; or that their sensitivities have been rubbed raw; or their serenity disturbed; or their composure discombobulated, by something that someone has said. Or by something they have seen. Such as a Confederate flag or a building named after Woodrow Wilson. But, actually, I think progressives are not sufficiently imaginative. There are many more things they could be indignant about. Starting with where I live—Washington, D.C. The Washington Post newspaper is -- if it will pardon the expression -- on the warpath against the name of the Washington Redskins football team. The paper says the name is racist, insulting, demeaning, insensitive, and so on. But the Washington Post takes its name from its city…which is named for George Washington, who was not only a slave owner; he was a tobacco farmer, which some progressives probably think is almost as awful. Surely the Post should change its name--and should demand that the nation's capital be renamed. Perhaps as Eleanor Roosevelt City. Obviously it cannot be named for her husband -- he who ordered the internment in concentration camps of 117,000 persons of Japanese descent, two-thirds of whom were native-born American citizens. And there are hundreds of other towns, counties, parks, and schools named for Washington. Such as Washington and Lee University. Good grief: The name is double hate speech: Robert E. Lee actually commanded the Confederate Army. Washington is not the only name progressives should scrutinize. If it is intolerable to have a football team named "Redskins," it must be worse to have a state named "Red People.” But let's get back to cleansing America of all mentions of historic figures who were less than perfect progressives. On the Tidal Basin in Washington there is a memorial for the slave-owning Thomas Jefferson. This memorial should have a "trigger warning" carved into its marble. Jacksonville, Florida, and Jackson, Mississippi, and many other places and things, are named for Andrew Jackson, the tormentor of Native Americans. All must be renamed for someone who was saintly, as progressives understand saintliness. And speaking of saints: Surely good progressives are traumatized by the names of St. Louis, St. Petersburg, San Diego, San Antonio—not to mention Corpus Christi. Progressives like it when courts rule that non-denominational prayers at high school graduations violate the separation of church and state. Why, then, don't they consider it a constitutional outrage that there are cities named for religious figures? Including Nancy Pelosi's San Francisco. That city is—if progressives will pardon the expression—the Vatican of American progressivism. Progressives should demand that all such cities be renamed for progressive saints. Tony Bennett could sing, "I left my heart in Nancy Pelosi City." Or we could give these places names that give no offense because they have no meaning. And it’s very, very interesting because I think a part of it is true. I think I’m a very notoriously positive comic. I think especially with the show I do it’s like very, very inclusive. We just did an episode called 'The Gender Fluid Polyamorous Prom' that was all about just including every lifestyle. And I think I'm notoriously on the PC end of things and I still get feedback from people that’s like really in attack mode about issues. And I’m like wow, I live on the fringe of – I live on the liberal progressive fringe of comedy, kind of notoriously and I get attacked sometimes. So I can imagine people who are a little bit more conservative, I think less – I think maybe some of the more blue collar comics take it on the chin. But it’s a very, very interesting thing because comics tend to have this knee-jerk reaction of 'Well we’re creative people and our work builds by doing it on stage again and again. We should be allowed to say and do whatever we want.' And I think there’s a lot of truth to that. I think comics do need permission to fail. I think comics do need permission to go up and try stuff. I’ve said some things on stage where the crowd was like, 'Whoa, that’s bad' – and I never say it again because that’s the feedback I get. And there’s a part of me that knows so much of it’s Internet driven. If somebody had a camera on and put that joke on the Internet and it went wide I’d be like, 'No, that’s why I tried it. That’s why I went and tried it because - to know that it wouldn't work and that it would bug everybody out.' That’s why I wouldn’t want to do it again or at least fix the parts that turned everybody off. So it is tough. But I think the other side of the coin that I think we as comics need to maybe cop to a little bit more is like we are allowed to say whatever we want. But also people are allowed to get as offended as they’re going to get. They’re allowed to and we don’t have to like it. They don’t have to like us and that’s totally fine. I think the troublesome point – like I have a friend Sam Morril. A great comic. Friend of mine, I know him through the comedy scene. We’re not the best friends in the world but I think he’s great and he’s such a sweet guy. And he made a joke once at a show that was really late at night that was billed as a really aggressively sort of like dirty risqué show. And he made a joke that involved the topic of rape and I don’t think he’d say it was the most well thought out, polished material. And someone wrote about it on a blog and it really blew up – and it really blew up. And it’s tough because it’s like there are certain topics that shouldn’t be joked about. At the same time if a joke about a topic can hit, it can actually be one of the most powerful tools to fight back against things we don’t like. So I really felt like, man, this guy Sam is a sweet dude. I know him. He’s a sweet dude. And he tried a joke at a show that was meant to be awful material and he’s getting slammed for being awful. And he never wanted to put – he was never going to record that for an album or put it on a special. So I remember thinking that was like – that’s like the nightmare scenario for a comedian and it’s not totally fair. But too many comedians use that as an excuse to just say whatever they want with no consequence and I don’t think that’s cool either. People want to get up and just say crazy things. People want to say stuff that’s like racist, homophobic, sexist. Just say like, 'Well I’m a comic, man, we’re the truth tellers in society! We just say whatever we want. You can’t judge us for it.' It’s like well you can. You can say whatever you want but if a crowd turns on you and if a think piece gets written that you've got bad intentions you might have to just own that. If you want to put that stuff out there you might just have to own it. It’s all valid. People’s reactions are as valid as our right to create. So I’ve seen situations that I think are really unfair to comics. I’ve seen situations where I think comics are really unrealistic about what creative expression and what the artistic freedom, what that entails.

For example, the British newspapers every day offend me with their laziness, their nastiness and they're in accuracy, but I'm not going to expect someone to stop that happening I just simply speak out about it. Sometimes when people are offended they want - you can just come in and say right stop that to whoever it is offending them. And, of course, as a former chairman of the BBC one said, "There are some people who I wish to offend." And I think there's truth in that too. So the idea that you have to be protected from any kind of uncomfortable emotion is what I absolutely do not subscribed to. And a fellow who I helped write two books about psychology and psychiatry was a renowned psychiatrist called Robert Skinner said something very interesting to me. He said, "If people can't control their own emotions then they have to start trying to control other people's behavior." And when you're around super sensitive people you cannot relax and be spontaneous because you have no idea what's going to upset them next. And that's why I've been warned recently don't to go to most university campuses because the political correctness has been taken from being a good idea, which is let's not be mean in particular to people who are not able to look after themselves very well, that's a good idea, to the point where any kind of criticism or any individual or group could be labeled cruel. And the whole point about humor, the whole point about comedy, and believe you me I thought about this, is that all comedy is critical. Even if you make a very inclusive joke like how would you make God laugh? Answer: tell him your plans. Now that's about the human condition; it's not excluding anyone. Saying we all have all these plans, which probably won't come and isn't it funny how we still believe they're going to happen. So that's a very inclusive joke. It's still critical. All humor is critical. If you start to say we mustn't, we mustn't criticize or offend them then humor is gone. With humor goes a sense of proportion. And then as far as I'm concerned you're living in 1984.
